The Office of Legal Counsel at the Justice Department, which is supposed to catch constitutional problems in pending legislation, only last year published a 41-page memorandum on the importance and limits of the appointments clause. People who wield the delegated sovereign powers of the federal government are officers subject to the appointments clause, the memorandum said, and judges certainly wield such power.
“Appointments clause issues were our bread and butter,” said John O. McGinnis, a law professor at Northwestern who was deputy assistant attorney general in the Office of Legal Counsel from 1987 to 1991. Professor McGinnis said Professor Duffy’s analysis appeared correct.
“You have to understand that O.L.C. looks at just an enormous number of bills,” he added. “A line attorney might just miss it.”
The Supreme Court will soon decide whether to take up the question, in the case involving Translogic, one with $86 million at stake.
“An improperly constituted tribunal should not be deciding the case,” said a lawyer for Translogic, Robert A. Long of Covington & Burling in Washington. “You have to go back and have the decision made by a properly constituted panel.”

Immigrants STEALING Impeachment

First of all, I'm all for the huddled masses. NOT the gangsters who are arriving huddled but then drop the sheepskin blankety and their glow in the dark tattoos and shit show up and they start terrorizing peaceful people and performing all kinds of murderous hobbies.

This shit ain't DRUG DEALING. This is a massacre.

AND, these are NOT immigrants protesting; it appears that they are Republicans or hired by the Republicans in order to subvert the hard work of groups who support impeachment and create MASSIVE demonstrations against the illegal wars and FOR the IMPEACHMENT OF GEORGE BUSH AND DICK CHENEY and the rest of them.

So, while I have helped out the Imokalee workers by supporting them and by a small donation to their cause, my larger belief upon close observation of them are that they are VERY VERY well organized. Right down to matching backpacks, professionally produced filmology and other things that struck me as less than genuine.

We're not talking union organizing we're talking something bigger and DIRTIER.

As in --- whenever the Impeachment and Anti-war groups get together yall do the same. THEN we can call it a big immigrant rights rally and be done with it.

A big example of this is in the May 1st Longshoreman's strike, shutting down the shipping lanes.

Scrubbing Death Records

Well, in Tampa it's VERY obvious that the corrupt Medical Examiner (whose staff has been veriously arrested for murder, attempted murder and former staff is in prison, etc....) will write anything they want on a death certificate.
Most people in Tampa die of lung cancer or heart attacks or boredom in Tampa. Yknow if it's nothing sorta obvious like ... gunshot, fire, knifing, RUN OVER, CAR WRECKED, MOTORCYCLE DEATH BY COUNTY ON A GOOD COP, or bashing the head in .... whatever. (did I mention random gunfire and stalking??)
Oh, and the whole complications from diabetes thingy. LMAO !!!! (they think they're getting away with something but they're NOT)

All three men were in an 'agitated' state and 'on drugs' when police officers shot them with Tasers, and the judge ordered their deaths be ruled 'accidental' also that any reference to "homicide or "electrical pulse stimulation" should be deleted from death certificates and autopsy reports."
Five sheriff's deputies had been indicted on charges related to the death of one of the men, who also had a history of mental illness. The judge further ordered that man's death be ruled as "undetermined" and to "delete any references to homicide and the death possibly being caused by asphyxia, beatings or other factors."

Wow. Not only the Taser reference is scrubbed, but all the other kinds of abuses common in police brutality cases! My, my. And yes, someone from Taser International had something to say about the ruling. It's after the jump.
